1.      Welcome to PhilRecruit Online. By using this Service, you agree to be bound by all of the terms of this Agreement. JML Internet Solutions  ("We") reserves all rights to change the terms of this Agreement or to modify any features of this Service at any time. By continuing to use this Service after the posting of Notices regarding such changes, you agree to be bound by such changes.

2.      You represent that you have read and agree to comply with all terms and conditions of this Agreement and guidelines posted on PhilRecruit Online.

3.      You will be responsible for all charges incurred, if any, including payment for any goods or services, and all statements or materials, including liability for harm caused by such statements or materials, while your account is being used. You may not transfer, sell, or otherwise assign your rights or obligations under this Agreement.

4.      You will be given a free web page if you avail at least the quarterly payment option. In the event you cancelled your subscription to PhilRecruit Online, JML Internet Solutions will automatically terminate or eliminate the publication of your free web page. 

5.      You will be issued an official receipt for all subscription fees due hereunder. All fees are nonrefundable. If you do not pay the entire amount of each subscription fee invoice within the time period set forth on the face thereof, JML Internet Solutions shall have the right, but not the obligation, without notice to you or the need to make demand for payment from you, to cancel and cease your subscription of PhilRecruit Online. Your subscription shall be automatically renewed according to your chosen payment frequency unless terminated by JML Internet Solutions or until you notify JML Internet Solutions of your wish to cancel your subscription. Subscription fees may be adjusted by JML Internet Solutions from time to time, and you will be notified of any such adjustment.

6.      This Service (including, but not limited to text, content, photographs, graphics, video and audio content) is protected by copyright as a collective work or compilation under the copyright laws of the Republic of the Philippines and other countries. All individual articles, content and other elements comprising this Service are also copyrighted works. You must abide by all additional copyright notices or restrictions contained in this Service.

7.      PhilRecruit Online is a registered trademark of JML Internet Solutions. All rights reserved. All other trademarks used in website of PhilRecruit Online are the property of their respective owners.

8.      (a) You may not copy, reproduce, redistribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Service, except that you may download material from this Service for your own personal, non-commercial use as follows: you may make one machine-readable copy and/or one print copy of materials included in the Service. Without limiting the generality of the foregoing, you may not distribute any part of this Service over any network, including a local area network, nor sell or offer it for sale. In addition, these files may not be used to construct any kind of database.

(b) PhilRecruit Online has been specially designed for presentation of content in a unique format and appearance to our users. We are concerned about the integrity of our Service when it is viewed in a setting created by a third party which includes advertising or other materials that we have not authorized to be displayed with our Service. Without limiting the provisions of 5(a), neither you nor any third party should make use of the contents of the Service in any manner that interferes with format and appearance of the Service as we have designed it. Illegal, fraudulent or abusive use of PhilRecruit Online is grounds for your being denied access to PhilRecruit Online and may be referred to law enforcement authorities.

9.      You agree to indemnify and hold harmless JML Internet Solutions, its directors, officers, shareholders, parents, subsidiaries, affiliates, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or the PhilRecruit Online guidelines, the submission of any material to PhilRecruit Online or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.

10.  This Service is available "as is." We do not warrant that this Service will be uninterrupted or error-free. There may be delays, omissions, interruptions and inaccuracies in the information or other materials available through this Service. We are not responsible for the availability or content of other services that may be linked to this Service. We do not make any warranties, and expressly disclaim all warranties express or implied, including without limitation, those of merchantability and fitness for a particular purpose, with respect to this Service or any information or goods that are available or advertised or sold through this Service. We do not make any representations, nor do we endorse the accuracy, completeness, timeliness or reliability of any advice, opinion, statement or other material or database displayed, uploaded or distributed in this Service or available through links in this Service. We reserve the right but are not required to correct any errors or omissions in this Service. These links are provided solely as a convenience to you and not as an endorsement by JML Internet Solutions of the contents on such third-party Web sites. We are not responsible for the content of linked third-party sites and do not make any representations regarding the content or accuracy of materials on such third party Web sites. If you decide to access linked third party Web sites, you do so at your own risk.

12.  PhilRecruit Online is only a venue. This Web Site acts as a venue for employers to source workers from recruiters, recruiters to advertise job opportunities and candidates to post resumes, and does not screen or censor the listings offered. We are not involved in the actual transaction between employers and recruiters, and between recruiters and candidates. As a result, we have no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of recruiters and employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site.

We are under no legal obligation to, and generally do not, control the information provided by other users, which is made available through the Web Site. By its very nature, other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using this Web Site.

The Material may contain inaccuracies or typographical errors. We make no representations about the accuracy, reliability, completeness, or timeliness of the Web Site or the Material. The use of the Web Site and the Material is at your own risk. Changes are periodically made to the Web Site and may be made at any time.

JML Internet Solutions is not to be considered to be an employer with respect to your use of the Web Site and we shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on the Web Site.

13.  (a) If you participate in any chat rooms, bulletin boards, or other forum within the site, you agree to not: (1) defame, abuse, harass or threaten others; (2) make any bigoted, hateful or racially offensive statements; (3) advocate illegal activity or discuss illegal activities with the intent to commit them; (4) post or distribute any material that infringes and/or violates any right of a third party or any law; (5) post or distribute any vulgar, obscene, discourteous or indecent language or images; (6) advertise or sell to, or solicit others; (7) post or distribute any software or other materials which contain a virus or other harmful component; or (8) post material or make statements that do not generally pertain to the designated topic or theme of any chat room or bulletin board.

(b) We reserve the right to remove or edit messages or material submitted by you. We are not responsible for material posted in chat rooms, on bulletin boards or on other forums by users of the site. By participating in any forum in the site you grant JML Internet Solutions an irrevocable, transferable and worldwide right to use, reproduce, publicly perform and display, distribute, sublicense, and sell any information, suggestions, ideas, drawings or concepts communicated to JML Internet Solutions for any purpose we choose, commercial, public or otherwise, without any compensation to you whatsoever.

14.  JML Internet Solutions and its officers, directors, shareholders, parents, subsidiaries, affiliates, agents, or licensors are not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including lost revenues or profits, loss of business or loss of data, in any way related to this Service or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in this Service (including, without limitation as a result of breach of any warranty or other term of this Agreement). Any claim against us shall be limited to the amount you paid, if any, for use of this Service.

15.  This Agreement may be terminated by either party for any reason at any time. Sections three (3) and six (6) through ten (10) of this Agreement shall survive such termination.

16.  This Agreement shall be governed by and interpreted under the laws of the Republic of the Philippines.
